Terms and conditions

Context, objective and purpose of the prize:

We move within a global environment and ideas know no more limits than the human capacity to create. There is therefore no limit to the scope of the communications or the type of candidate.

That said, the jury could also favourably consider whether the idea in question had an impact on the city of Lleida and/or whether it had been developed by people, companies or entities associated with this city or the local territory.

The prize sought to award the best idea of all those presented which had been turned into a specific product, service and/or process and applied to some aspect of the real world. 

This idea had to be converted into a specific product, service and/or process applied to some aspect of the real world. It had to be based on the use of new technologies and services and should help to promote a paradigm shift and the improvement of the daily lives of people, companies and/or society as a whole.

Those eligible for the prize:

The candidates could be physical or legal persons, companies or legally constituted entities and could be local, national or international in nature.

Description of the prize, assignments and requisites for participation:

  • Description of the prize and assignment
    The prize to be awarded consisted of:
    • A symbolic amount.
    • € 5,000 which the prize-winner had either to put towards a project or used to improve an existing project –which had to be their own or belong to someone else, but which had been proposed by the prize-winner- relating to innovation, research, technological dissemination and/or social change. This project had to be of interest to public administrations and/or imply making an improvement to public services or offering benefits to the general public.

      This project had to be subject to rules and regulations laid out in these terms and conditions.

    The jury was able to award an honourable mention if this would be judged appropriate. Such an honourable mention would be exclusively reserved for ideas presented by people, companies or entities associated with the city of Lleida and/or its immediate territory.

    If the jury decided to award an honourable mention, this consisted of:

    • A symbolic amount.
    • € 3,000 which the prize-winner had either to put towards a project or used to improve an existing project –which had to be their own or belong to someone else, but which had been proposed by the prize-winner- relating to innovation, research, technological dissemination and/or social change. This project had to be of interest to public administrations and/or imply making an improvement to public services or offering benefits to the general public.

      This project had to be subject to the regulations laid down in these rules.

    Lleida City Council reserves the right to use and freely publicise the name, image and professional career of the prize-winners, the logos of the companies associated with the prize, the content and images of the prize-winning projects and of the prize ceremony, and also of any other projects initiated as a result of the competition.

    The prize had to be subject to the fiscal obligations applicable at the time of it being awarded. 

  • Requirements for participation
    The prize-winning idea or project had to meet the requirements established in the terms and conditions. It had to be an original idea and had to not infringe any existing patents, authors' rights or any other copyrights, laws or regulations.

    The winning idea or project had to have been developed by a person, company and/or entity with the technical capacity and legal status required to do this.
 

The call for participation and presentation of candidacies and the model for participation

  • The call for participation
    The call for participation had to be carried out by the competent organisation, commission or board of Lleida City Council, which determined the period for the presentation of candidates.

  • The presentation of candidacies and the model for participation
    The presentation of candidacies was open and free. It was based on the use of the network and on what are known as "crowd proposals": proposals made, supported and selected by people and entities via the network.

    All people, companies and institutions were able to propose candidates through the web service that Lleida City Council made available for this purpose. In the proposal presented, candidates explained and justified their idea, providing minimum contact details and a web address that made it possible to see and evaluate their idea and measure its impact.

    The pre-selection process was carried out via this web service, in an open and participative way. This process was open and allowed people to express their support for the candidacies presented. 
  • The documentation
    The period and conditions for the presentation and the process of participation, support and debate was also specified via this network service web.   

Criteria for evaluating the proposals

The criteria that the jury used when making its assessment was:

  • The possibility of converting an idea into a product, service and/or concrete process that can be applied to some aspect of life in the real world and which involves the use of new technologies and services that can foster a paradigm shift and help to improve people's daily lives.

  • Innovation when this implies changes and improvements that benefit people, society and/or companies.

  • The recognition of creative and transforming activity within a new, global world and network.

  • The capacity to multiply the idea so that it can generate new initiatives, new projects and new ideas.

  • One possible, but not exclusive, criterion that was considered was whether the idea and its associated initiatives have had an impact - amongst other targets - on the people, society, environment and market closest to the city of Lleida.

  • One of the evaluation criteria to bear in mind -which was a possibility, but not an obligation, except in the case of awarding an honourable mention- was that the ideas and initiatives rewarded should have an impact on the people, society, environment and market of the city of Lleida and/or its immediate territory.

  • Another of the evaluation criteria to bear in mind -which was a possibility, but not an obligation, except in the case of awarding an honourable mention- was that the ideas and initiatives rewarded should be carried out by people, companies or entities associated with the city of Lleida and/or its immediate territory.

Considerations with respect to projects initiated as a result of the prize

As specified in the "Prize" section, the prize money was € 5,000, which the prize-winner had to dedicate to a project – of their own or of someone else - involving innovation, research, technological diffusion and/or social change.

These projects had to be of interest to public administrations and/or imply improving public services or people's lives.

These projects were been considered services contracted by Lleida City Council which were of interest to public administrations and/or which would imply improvements to public services or people's lives.

This contract had, as established by law, to be subject to the laws and norms established for Public Sector contracts, with the corresponding financial checks and controls and the corresponding fiscal obligations and retentions; it had also to be subject to the tax laws operative at the time. The receiver of the contract had to be a physical person or legal entity with the technical and legal capacity to carry it out.

The winner, and also the final receiver of the contract, accepted all of the conditions laid down in these rules. If the winner decided not to execute the new project contemplated by the prize, this had to imply renouncing the total economic value of the prize, and the winner had to not receive any other form of economic compensation.

The winner, and the final recipient of the contract, had to regularly inform Lleida City Council of the evolution of the projects carried out as a result of the prize, so that it could publicise this work, know how it was evolving and guarantee that it was carried out in compliance with the terms of the contract and current laws and regulations.

Lleida City Council reserves the right to freely use and disseminate the content and the image of any projects contracted, including the dissemination of any associated logos and brands.

The winner, and the final recipient of the contract, promised to mention this prize awarded by Lleida City Council in any dissemination that they made of the project.

Any copyright or any other possible rights relating to contents and/or patents associated with these projects shall belong to their creators. Lleida City Council reserves the right to the free and unlimited use of these patents in accordance with the conditions established in the corresponding contract.

The final recipient of the contract hereby guaranted that the contracted project would be original and would not infringe any trademarks, patents regulations or other third party rights.

The final receiver of the contract would be responsible for, and would fully assume, any costs or charges which could originate from any potential claims or disputes that may arise from breaches of any existing regulations, poor quality, third-party damages, breaches of contract and/or any other obligations.

Rights relating to intellectual and industrial property

The copyright and contents belong to the creators of the different projects.

This work couldn't be used or distributed without the explicit agreement of the author.

That said, the participants, and also the final receiver of the contract linked to the prize, knowingly give their explicit consent for the use and distribution of promotional material associated with the work presented in this competition, both for the uses of the organisation and staging of the competition and also for any present and future promotional activities that Lleida City Council may consider appropriate.

Everyone participating in the competition, including those who didn't win prizes, and also the final recipient of the contract linked to the prize, agreeded that the proposals presented had to be original and, in line with the conditions outlined in the previous paragraph, that they would not breach any existing regulations or third-party rights and that they would be free from any charges, encumbrances and/or third party rights.

The participants, and the final recipient of the contract linked to winning the prize, would -at all times- ensure that Lleida City Council remained protected from any potential third party claims. The participants and final recipients of the contract would be responsible for, and fully assume, any possible cost or economic charge that could be payable to third parties as a consequence of legal actions, claims and/or conflicts arising from breaches of the obligations established in these bases.

Acceptance of the terms and conditions

Participating in this competition implied accepting all of the terms and conditions and expressly agreeing their interpretation by Lleida City Council.

Each participant, and also the final recipient of the contract linked to winning the prize, authorised Lleida City Council and all of the members of the jury to use their name and image in publicity material associated with the competition without receiving any compensation for this.

The participants responsibly declared that the works and their contents, voluntarily contributed to the competition, did not infringe any third-party rights.  

The participants, and the final recipient of the contract linked to winning the prize, would be responsible for any infringements caused to, or that could be caused to, the rights of third parties through the participation of the works presented or their contents, and they would be responsible for compensating these third parties and, if necessary, the members of the competition jury who might be affected, and Lleida City Council, for any damages incurred due to failure to comply with the previously described obligation.
